All rights, including copyright, in the content of these Scribas.com web pages are owned or controlled for these purposes by Scribas LLC. In accessing Scribas.com, you agree that you may only download the content for your own personal non-commercial use.

Sending DMCA Notification

It is Scribas' policy to (1) block access to or remove material that it believes in good faith to be copyrighted material that has been illegally copied and distributed by any of our users; and (2) remove and discontinue service to repeat offenders.

We respect the intellectual property rights of others and we prohibit users from uploading, posting or otherwise transmitting on the Scribas website or service any materials that violate another party's intellectual property rights. When we receive proper Notification of Alleged Copyright Infringement as described below, we promptly remove or disable access to the allegedly infringing material and terminate the accounts of repeat infringers in accordance with the Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512(c)(3)).

If you believe that your copyright-protected work has been copied and posted on Scribas in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:

(i) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

(ii) A description of the copyrighted work that you claim has been infringed; Identify in detail the copyrighted work that you claim has been infringed so that we are able to locate the material. For example, "The copyrighted work that is my content that appears at http://www.mysite.com/page1.html".

(iii) A description of where the material that you claim is infringing is located on the Scribas site. This includes a URL of where the content is visible and, if possible, a URL of how you reached this page;

(iv) Include your name, mailing address, telephone number and email address;

(v) A written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

(vi) A statement by you that the above information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.

Scribas Action After DMCA Notification

Once Proper Bona Fide Infringement Notification is Received by the Scribas Designated Agent, it is Scribas' policy:

1. to remove or disable access to the infringing material;
2. to notify, where possible, the user that Scribas has removed or disabled access to the material; and
3. that repeat offenders will have the infringing material removed from the system and that Scribas will terminate such user's access to the website and service.

DMCA Counter Claim

If the user believes that the offending material that was removed or to which access was disabled is either not infringing, or the user believes that it has the right to post and use such material from the copyright owner, the copyright owner's agent, or pursuant to the law, the user must send a counter-notice containing the following information, in English, to the Designated Agent listed below:

(i) A physical or electronic signature of the user;
(ii) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
(iii) A statement that the user has a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material; and
(iv) User's name, address, telephone number, and, if available, e-mail address and a statement that such person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the user's address is located, or if the user's address is located outside the United States, for any judicial district in which Scribas is located, and that such person or entity will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Designated Agent, Scribas may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the user, the removed material may be replaced or access to it restored in 10 to 14 business days after receipt of the counter-notice, at Scribas' discretion.
